Terms of Service

1. Acceptance of Terms
By accessing or using Upscale Media ("the Service"), including our website, trial upscaler, dashboard, or API, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
Upscale Media provides AI-powered image upscaling through:
- Trial Upscaler: A free, anonymous tool on our homepage that allows you to upscale images without creating an account, subject to the limitations described in Section 3.
- Dashboard: A web-based interface for registered users to upload, manage, and download upscaled images.
- API: A RESTful API for programmatic access to the upscaling service, authenticated via API tokens.
Image processing is performed asynchronously. When you upload an image, it is queued for processing and you will be notified when it is complete. Processing times vary based on server load.
3. Trial Upscaler
The trial upscaler is available without an account and is subject to the following limitations:
- Maximum file size: 5MB
- Rate limit: 10 uploads per hour per IP address
- Supported formats: JPEG, PNG, WebP, BMP, TIFF, GIF
- Trial images are automatically deleted after 24 hours
- We collect your IP address and user agent for rate limiting and abuse prevention
4. Account Registration
To access the full Service (dashboard and API), you must create an account with a valid email address and verify it. You may also sign in using Google or GitHub, in which case we import your name, email, and profile photo from the provider. If you sign in with a social provider and your email matches an existing Upscale Media account, the accounts will be linked automatically.
You are responsible for maintaining the confidentiality of your account credentials, including API tokens, and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
5. Subscription Plans and Billing
We offer the following plans:

- Paid plans are billed monthly through Stripe. You may cancel at any time, with access continuing through the end of your billing period (grace period).
- If you cancel a paid plan, your images will be retained for at least 30 days after cancellation to give you time to download them, regardless of your plan's normal retention period.
- Enterprise plans are available at multiple volume tiers (1,000 / 2,500 / 5,000 / 12,500 images per month).
6. Image Retention and Deletion
Images are automatically deleted after the retention period for your plan (see table above). Trial images are deleted after 24 hours. You can manually delete your images at any time from your dashboard. Once the retention period expires, both the original and upscaled files are permanently removed from our servers.
We recommend downloading your upscaled images promptly. We are not responsible for images lost after the retention period expires.
7. API Usage and Rate Limits
API access is subject to rate limits based on your subscription plan:

Batch upload endpoints are available to Professional and Enterprise plans only. We reserve the right to throttle or suspend API access for accounts that violate these terms or engage in abusive behavior. Exceeding rate limits will return HTTP 429 responses.
8. Acceptable Use
You agree not to:
- Upload content that is illegal, harmful, or violates the rights of others
- Attempt to circumvent usage limits, rate limiting, or abuse prevention measures
- Use the Service for automated scraping or bulk processing beyond your plan limits
- Share your API tokens with unauthorized parties
- Reverse engineer or attempt to extract our AI models or service infrastructure
- Use automated tools to bypass the trial upscaler's rate limits
9. Intellectual Property
You retain all rights to images you upload and their processed outputs. Upscale Media does not claim ownership of your content and does not use your images for AI model training. Our platform, branding, AI technology, and all associated intellectual property remain the property of Upscale Media.
10. Service Availability
We strive to maintain reliable service but do not guarantee uninterrupted access. We may perform maintenance or updates that temporarily affect availability. We will provide notice when possible. Image processing depends on the availability of our GPU infrastructure and may occasionally experience delays.
11. Limitation of Liability
Upscale Media is provided "as is" without warranties of any kind, express or implied. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or business interruption. Our total aggregate liability is limited to the amount you paid us in the 12 months preceding any claim.
12. Termination
We may suspend or terminate your account if you violate these terms. You may delete your account at any time from your profile settings. Upon account deletion, all associated data (images, usage logs, API tokens, and personal information) is permanently deleted immediately. Active subscriptions will be cancelled through Stripe.
13. Changes to Terms
We may update these terms from time to time. We will notify you of significant changes via email or through the Service at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
14. Governing Law
These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved in accordance with applicable law.
